THE DEVICES WERE PURCHASED to comply with the Help America Vote Act that Congress passed in 2002. The law was designed to give voters with disabilities the devices that would guarantee them the same accessibility and privacy in the voting booth offered to everyone else. No right is more precious in a free country than that of having a voice in the election of those who make the laws under which, as good citizens, we must live. Other rights, even the most basic, are illusory if the right to vote is undermined. - U.S. Supreme Court, Wesberry v. Sanders (1964)

HAVA imposes numerous requirements for new voting systems. As a result, New York must replace its old lever machines with upgraded modern technology capable, among other things, of providing access for individuals with disabilities, alternative language accessibility, and a permanent paper record with a manual audit capacity.  Elliot Spitzer, Attorney General NYS From Voting Matters II, Feb 05

After inquiring about transportation, Independent Living, Inc has also received the following letter from Orange County Election Commissioners Green and Bahren.
 

 Text of the letter:
 
        The Orange County Board of Elections is committed to the full implementation of the Help America Vote Act including the requirements stipulated under the DOJ settlement with New York State for Plan B in 2006.
 
         As part of that agreement, Orange County agreed to provide  transportation to those disabled voters requiring such services this year to any of the four sites of the ballot marking devices in the county on Primary and Election Day.  Although we are still working through the details of securing transportation  we can provide the answers to your questions.
 
     1.  Will a fare be charged? No.
 
        2.  How many rides are being planned (anticipated)?   As noted we are still in the process of securing the transportation.  We are looking to have two vehicles available from locations in the eastern and western sides of the county to transport voters.
 
      3.   Will they be available from anywhere in the county?  Yes, transportation service will still be available from any location in the county to one of the four ballot marking devices.
 
        4.  Will there be a time allotment for voting between arrival and the return trip?  We will request that disabled voters requiring transportation call the Board of ELections to schedule the time that transportation is needed.
 
        5.  Is some or all of the transportation being provided accessible?  Yes all of the transportation will be accessible.

        6. Will it be necessary to make a reservation for a rided before primary day?  Election Day?  If so, with whom, and by when must the reservation be made?  A request will be made that reservations be made in advance of the election, however we are aware that circumstances will arise that some voters will need transportation services and will contact the Board on Election Day.

        7.  Will a voter be able to bring family, children, service animals, etc. to accompany the voter to and from the polls? If so what, if any are the restrictions? 
Yes the voter may bring another person, whether a family member or someone else with them to the ballot marking device location in the vehicle.  Yes, a service animal will always be welcome.
